A 31-year-old Santa Ana man was arrested early Tuesday on suspicion of having sex with a 12-year-old girl after officers allegedly found the two inside his vehicle, police said.
Neftali Pena Procopio was apprehended about 2 a.m. after officers allegedly discovered the two partially clothed in the back seat of the car, the Santa Ana Police Department said.
"The officers rolled up and saw the windows fogged, which was suspicious," said Cpl. Anthony Bertagna. "They get out and there's used condoms on the ground."
Officers shined their light into the car and saw two people "having sexual intercourse," Bertagna said.
He said the girl was having "family issues" and was playing basketball at Santa Ana High School about 7:30 p.m. Monday when the man approached and began talking to her. After exchanging numbers, Procopio called the girl and they met later that night.
The girl told police that she had told Procopio she was 16, and that he said he was 20, according to Bertagna.
Procopio was booked on charges of engaging in a lewd and lascivious act with a minor under 14. He was being held in a Santa Ana jail in lieu of $100,000 bail, police said.
